1. Definitions

• Operator / Service Provider — EdgeFlow AI, contact via Telegram @vexxee.
• Service — the EdgeFlow AI software and related materials provided via the Telegram bot, the website edgeflowai.net and associated channels.
• User — any natural or legal person using the Service.
• Subscription — the paid Trader plan giving access to the features of the Service described at edgeflowai.net/pricing.html.
• Content — market analyses, signals, alerts, statistics, AI-generated commentary and any other information delivered through the Service.

2. General provisions

These Terms set out the rules for using the EdgeFlow AI Service. By using the Service, the User confirms they have read and accepted these Terms. Using the Service requires acceptance of these Terms in full.

The User must be at least 18 years old and have full legal capacity to enter into a binding agreement.

3. Nature of the Service — important

EdgeFlow AI is an analytical and educational tool. It does not constitute investment advice, financial advisory, a recommendation to buy or sell any financial instrument, an offer, or a solicitation within the meaning of applicable law.

The Content is generated automatically, including by artificial intelligence models, on the basis of publicly available market data and the Operator's own algorithms. The Content may be incomplete, delayed or contain errors.

All trading and investment decisions are taken by the User independently, at their own risk and responsibility. The Operator is not a party to any transaction the User executes on cryptocurrency exchanges or any other venue.

Trading in leveraged derivatives (futures) involves a high risk of losing all or part of the invested capital. Past performance and historical statistics do not guarantee future results.

4. Technical requirements

Using the Service requires: a device with internet access, an active Telegram account, and — for certain features — accounts with the relevant cryptocurrency exchanges. The Operator is not responsible for the availability or operation of third-party services (Telegram, exchanges, payment providers).

5. Account and access

Access to the Service is granted through the Telegram bot. The User is responsible for keeping their access credentials, API keys and exchange permissions secure. The User must never share private keys or exchange API secrets with the Operator or third parties.

6. Subscriptions and payments

• The scope of features, the price and the billing period of the Service's single plan — Trader, 100 USDT per month — are described at edgeflowai.net/pricing.html and form an integral part of these Terms.
• Payments are made in cryptocurrency (e.g. USDT) using the methods indicated by the Operator. The subscription is activated after the Operator confirms the payment.
• Unless stated otherwise, a subscription is granted for a defined period and does not renew automatically; renewal requires a new payment.
• Due to the nature of crypto payments, the User is responsible for sending the correct amount to the correct address and network; transactions are irreversible.

7. Right of withdrawal

For consumers in the EU, the right to withdraw from a distance contract within 14 days may apply. However, for digital content/services delivered immediately, this right is lost once performance has begun with the consumer's prior express consent and acknowledgement that they thereby lose the right of withdrawal. By activating a subscription and beginning to use the Service, the User provides such consent. Any refund requests can be submitted via the contact channels below and will be handled in line with applicable consumer law.

8. Complaints

Complaints may be submitted via Telegram @vexxee. The Operator will respond within 14 days. A complaint should include a description of the issue and the User's Telegram identifier.

9. Limitation of liability

To the fullest extent permitted by law, the Operator is not liable for any trading losses, lost profits, or indirect or consequential damages arising from the use of the Content or the Service. The Service is provided "as is" and "as available", without warranty of uninterrupted or error-free operation.

Nothing in these Terms excludes liability that cannot be excluded under mandatory law (including consumer protection law).

10. Acceptable use

The User must not: resell or redistribute the Content without authorisation; use the Service for unlawful purposes; attempt to circumvent access controls; scrape, copy or reverse-engineer the Service; or disrupt its operation.

11. Intellectual property

All rights to the Service, software, logo, design and Content belong to the Operator or its licensors. A subscription grants a limited, non-exclusive, non-transferable right to use the Service for personal purposes only.

12. Termination

The Operator may suspend or terminate access in case of a material breach of these Terms. The User may stop using the Service at any time; for active subscriptions, the rules in Sections 6–7 apply.

13. Changes to the Terms

The Operator may amend these Terms for valid reasons (legal, technical or organisational changes). Users will be informed of changes via the website or Telegram. Continued use after the effective date constitutes acceptance.

14. Governing law and disputes

These Terms are governed by the law of Poland. Disputes shall be resolved by the competent common court, subject to mandatory consumer rules that may grant consumers the right to their local court. Consumers may also use out-of-court dispute resolution, including the EU ODR platform.

• Operator / Usługodawca — EdgeFlow AI, kontakt przez Telegram @vexxee.
• Usługa / Serwis — oprogramowanie EdgeFlow AI oraz powiązane materiały dostarczane przez bota Telegram, stronę edgeflowai.net i powiązane kanały.
• Użytkownik — osoba fizyczna lub prawna korzystająca z Usługi.
• Subskrypcja — płatny plan Trader dający dostęp do funkcji Usługi opisanych na edgeflowai.net/pricing.html.
• Treści — analizy rynkowe, sygnały, alerty, statystyki, komentarze generowane przez AI oraz inne informacje dostarczane w ramach Usługi.

2. Postanowienia ogólne

Niniejszy Regulamin określa zasady korzystania z Usługi EdgeFlow AI. Korzystając z Usługi, Użytkownik potwierdza, że zapoznał się z Regulaminem i go akceptuje. Korzystanie z Usługi wymaga akceptacji Regulaminu w całości.

Użytkownik musi mieć ukończone 18 lat i posiadać pełną zdolność do czynności prawnych umożliwiającą zawarcie wiążącej umowy.

3. Charakter Usługi — ważne

EdgeFlow AI jest narzędziem analityczno-edukacyjnym. Nie stanowi porady inwestycyjnej, doradztwa finansowego, rekomendacji kupna lub sprzedaży jakiegokolwiek instrumentu finansowego, oferty ani zachęty w rozumieniu obowiązujących przepisów.

Treści są generowane automatycznie, w tym przez modele sztucznej inteligencji, na podstawie publicznie dostępnych danych rynkowych oraz autorskich algorytmów Operatora. Treści mogą być niekompletne, opóźnione lub zawierać błędy.

Wszelkie decyzje inwestycyjne i transakcyjne Użytkownik podejmuje samodzielnie, na własne ryzyko i odpowiedzialność. Operator nie jest stroną żadnej transakcji zawieranej przez Użytkownika na giełdach kryptowalut ani w innym miejscu.

Handel lewarowanymi instrumentami pochodnymi (futures) wiąże się z wysokim ryzykiem utraty całości lub części zainwestowanego kapitału. Wyniki historyczne i statystyki nie gwarantują wyników przyszłych.

4. Wymagania techniczne

Korzystanie z Usługi wymaga: urządzenia z dostępem do internetu, aktywnego konta Telegram oraz — dla niektórych funkcji — kont na odpowiednich giełdach kryptowalut. Operator nie odpowiada za dostępność ani działanie usług podmiotów trzecich (Telegram, giełdy, dostawcy płatności).

5. Konto i dostęp

Dostęp do Usługi udzielany jest przez bota Telegram. Użytkownik odpowiada za bezpieczeństwo swoich danych dostępowych, kluczy API i uprawnień giełdowych. Użytkownik nigdy nie udostępnia kluczy prywatnych ani sekretów API giełd Operatorowi ani osobom trzecim.

6. Subskrypcje i płatności

• Zakres funkcji, cena i okres rozliczeniowy jedynego planu Usługi — Trader, 100 USDT miesięcznie — opisane są na edgeflowai.net/pricing.html i stanowią integralną część Regulaminu.
• Płatności realizowane są w kryptowalucie (np. USDT) metodami wskazanymi przez Operatora. Subskrypcja jest aktywowana po potwierdzeniu płatności przez Operatora.
• O ile nie wskazano inaczej, subskrypcja udzielana jest na określony czas i nie odnawia się automatycznie; przedłużenie wymaga nowej płatności.
• Ze względu na charakter płatności krypto, Użytkownik odpowiada za wysłanie prawidłowej kwoty na prawidłowy adres i w prawidłowej sieci; transakcje są nieodwracalne.

7. Prawo odstąpienia

Konsumentom w UE może przysługiwać prawo odstąpienia od umowy zawartej na odległość w terminie 14 dni. Jednak w przypadku treści/usług cyfrowych dostarczanych niezwłocznie prawo to wygasa z chwilą rozpoczęcia świadczenia za uprzednią wyraźną zgodą konsumenta i potwierdzeniem przez niego utraty prawa odstąpienia. Aktywując subskrypcję i rozpoczynając korzystanie z Usługi, Użytkownik wyraża taką zgodę. Ewentualne wnioski o zwrot można składać kanałami kontaktu wskazanymi poniżej; będą rozpatrywane zgodnie z obowiązującym prawem konsumenckim.

8. Reklamacje

Reklamacje można składać przez Telegram @vexxee. Operator odpowie w terminie 14 dni. Reklamacja powinna zawierać opis problemu oraz identyfikator Telegram Użytkownika.

9. Ograniczenie odpowiedzialności

W najszerszym dopuszczalnym przez prawo zakresie Operator nie ponosi odpowiedzialności za straty wynikające z transakcji, utracone korzyści ani szkody pośrednie lub następcze powstałe w związku z korzystaniem z Treści lub Usługi. Usługa świadczona jest „tak jak jest" i „w miarę dostępności", bez gwarancji nieprzerwanego ani bezbłędnego działania.

Żadne postanowienie Regulaminu nie wyłącza odpowiedzialności, której nie można wyłączyć na mocy bezwzględnie obowiązujących przepisów (w tym przepisów o ochronie konsumentów).

10. Dozwolone korzystanie

Użytkownik nie może: odsprzedawać ani redystrybuować Treści bez upoważnienia; korzystać z Usługi w celach niezgodnych z prawem; obchodzić zabezpieczeń dostępu; scrapować, kopiować ani odtwarzać kodu Usługi; ani zakłócać jej działania.

11. Własność intelektualna

Wszelkie prawa do Usługi, oprogramowania, logo, designu i Treści należą do Operatora lub jego licencjodawców. Subskrypcja udziela ograniczonego, niewyłącznego i nieprzenoszalnego prawa do korzystania z Usługi wyłącznie do celów osobistych.

12. Rozwiązanie umowy

Operator może zawiesić lub zakończyć dostęp w przypadku istotnego naruszenia Regulaminu. Użytkownik może zaprzestać korzystania z Usługi w dowolnym momencie; dla aktywnych subskrypcji obowiązują zasady z pkt 6–7.

13. Zmiany Regulaminu

Operator może zmienić Regulamin z ważnych przyczyn (zmiany prawne, techniczne lub organizacyjne). O zmianach Użytkownicy będą informowani przez stronę lub Telegram. Dalsze korzystanie po wejściu zmian w życie oznacza ich akceptację.

14. Prawo właściwe i spory

Regulamin podlega prawu polskiemu. Spory rozstrzyga właściwy sąd powszechny, z zastrzeżeniem bezwzględnych przepisów konsumenckich mogących przyznawać konsumentom prawo do sądu właściwego dla ich miejsca zamieszkania. Konsumenci mogą też skorzystać z pozasądowych metod rozwiązywania sporów, w tym z platformy ODR UE.
